
Carrington Coleman attorneys routinely represent secured and unsecured creditors in collection actions in state and federal courts throughout Texas. Our practice also involves a substantial volume of commercial foreclosures and representation of lender creditors in bankruptcy proceedings, including some of the most complex business reorganizations. We have also handled a large volume of loan workouts and lender liability litigation in connection with defaulted loans for both borrowers and lenders. This practice has given us the opportunity to play critical roles in several significant lender liability cases, on both sides of the docket, including matters involving allegations of deceptive trade practices, fraud, and breach of fiduciary duty or of the duty of good faith and fair dealing. In a recent matter, we represented an investment bank against claims for relinquishment of liens and disgorgement arising under the federal Perishable Agricultural Commodities Act ("PACA"). We have also represented borrowers, corporate directors and officers, accountants, attorneys, and other professionals in defending against complex and expansive claims brought by federal regulatory agencies as receivers or successors of failed financial institutions.
