The Art of Law

Every endeavor
has its own art, whether it’s hitting
a baseball, writing
a symphony,
or handling a lawsuit. In the
legal arena there’s an art to envisioning solutions where others see problems. It has
to do with understanding how to resolve matters in a way that benefits each client. It has to do with the art of helping clients contain problems and expand opportunities.

Carrington Coleman has extensive experience and expertise in matters arising in the aviation industry.  We represented the City of Dallas in complex state and federal litigation, administrative proceedings, and appeals that resolved conflicts over the regulation of scheduled passenger traffic at Dallas Love Field Airport.  We are currently representing the Dallas/Fort Worth International Airport Board in connection with an insurance coverage issue, and have handled other litigation and consulting matters for that entity in recent years.  We represent one of the country’s largest airlines in disputes over airport construction and federal aviation regulations.  We have defended airplane and related equipment manufacturers in product liability lawsuits.

The firm’s aviation experience and practice includes representing major carriers, general aviation manufacturers and aviation component manufacturers and suppliers.  We have defended, at the trial court and appellate level, products liability, property damage, warranty, contract, indemnity, insurance and subrogation, and loan documentation and lien perfection issues involving these clients.  These representations have also involved issues of federal preemption, national and international tariff regulations, and FAA and state regulatory questions.

We have represented financing sources in asset-based lending arrangements with engine, airframe, and aircraft collateral.  These matters involved structuring and documentation of aircraft- and engine-leasing and loan transactions, creation of international interests under the Capetown Convention (requiring familiarity with both the FAA regulatory scheme and practices and the Convention), advice concerning credit structure, collateral priorities, security interest priorities, aftermarket parts liquidation arrangements, interface with Federal Aviation Administration counsel in Oklahoma City, and structuring of intercreditor arrangements.

Carrington Coleman has additional experience with significant USA domestic carriers, providing representation to the airline, secured bank lenders, aircraft and parts manufacturers, hedge fund bondholders, agents for secured bank lenders, transportation lenders, lessors of equipment, and assisting in the purchase of multiple L1011 aircraft.  These representations include significant experience in numerous domestic aviation Chapter 11 bankruptcies.

We represent a major airline carrier in discrimination/retaliation litigation filed in Dallas.  In addition, we have provided seminars for the airline’s in-house legal department on electronic discovery, nationwide compliance with subpoenas for employment records, and we are developing a new seminar on specific compliance issues related to the Americans with Disabilities Act.
